Patent rights on pharmaceutical products are one of the factors responsible for the lack of access to affordable medicines in developing countries. In this work, Emmanuel Kolawole Oke provides a systematic analysis of the tension between patent rights and human rights law, contending that, in order to preserve their patent policy space and secure access to affordable medicines for their citizens, developing countries should incorporate a model of human rights into the design, implementation, interpretation, and enforcement of their national patent laws. Through a comprehensive analysis of court decisions from three key developing countries (India, Kenya, and South Africa), Oke assesses the effectiveness of national courts in resolving conflicts between patent rights and the right to health, and demonstrates how a model of human rights can be incorporated into the adjudication of patent rights.

This is an open access title available under the terms of a CC BY-NC-ND 4.0 International licence. It is free to read at Oxford Scholarship Online and offered as a free PDF download from OUP and selected open access locations. Notwithstanding the terrible price the world has paid in the coronavirus pandemic, the fact remains that longevity at older ages is likely to continue to rise in the medium and longer term. This volume explores how the private and public sectors can collaborate via public-private partnerships (PPPs) to develop new mechanisms to reduce older people's risk of outliving their assets in later life. As this volume shows, PPPs typically involve shared government financing alongside private sector partner expertise, management responsibility, and accountability. In addition to offering empirical evidence on examples where this is working well, contributors provide case studies, discuss survey results, and examine a variety of different financial and insurance products to better meet the needs of the aging population. This volume will be informative to researchers, plan sponsors, students, and policymakers seeking to enhance retirement plan offerings.

This comprehensive scholarly book on comparative federalism and the Covid-19 pandemic is written by some of the world's leading federal scholars and national experts.

The Covid-19 pandemic presented an unprecedented emergency for countries worldwide, including all those with a federal or hybrid-federal system of government, which account for more than 40 per cent of the world's population. With case studies from 19 federal countries, this book explores the core elements of federalism that came to the fore in combatting the pandemic: the division of responsibilities (disaster management, health care, social welfare, and education), the need for centralisation, and intergovernmental relations and cooperation. As the pandemic struck federal countries at roughly the same time, it provided a unique opportunity for comparative research on the question of how the various federal systems responded. The authors adopt a multidisciplinary approach to question whether federalism has been a help or a hindrance in tackling the pandemic. The value of the book lies in understanding how the Covid-19 pandemic affected federal dynamics and how it may have changed them, as well as providing useful lessons for how to combat such pandemics in federal countries in the future.

This book will be of great interest to students and scholars of politics and international relations, comparative federalism, health care, and disaster management.

Globalization is a form of social change, reshaping the socio-spatial milieu in which humans strive, and in which health and disease are managed and controlled. And yet the effects of globalization are distributed unevenly, with opportunities open for some but not for all.

Globalization, Health and the Global South is an important textbook for any student of this fascinating area. Examining the dynamics of globalization through the lens of the Global South, it highlights risks and vulnerabilities that affect different regions and contexts, exacerbating inequalities despite the continuing speed of global processes. The books takes a critical approach to the topic, offering readers a deep understanding of health discourses and discusses a range of key topics, including migrant health, the role of politics and diplomacy and the Coronavirus pandemic.

Including further reading and end of chapter discussion questions, this essential textbook will be important reading for students across the health and social sciences.

The book investigates digitalisation in care for older people by giving insight into service users' and professionals' opportunities to digital agency in the context of European welfare states.

With a focus on service users and providers experiences of digital care, the contributions address the manifold and often contradictory consequences of active ageing policies and innovation programmes. To assess digital agency of older people, ageism and co-creation in the innovation processes as well the use of digital platforms are addressed, while care professionals' digital agency is examined through empirical cases that focus on the interaction between human and non-human actors in long-term care services, the temporality and spatiality of care, and the organisational requirements for successful implementation of digital technologies.

From a variety of conceptual and theoretical viewpoints, the chapters provide a comprehensive and timely overview of ways to address the phenomena of ageing and digitalisation. The book provides critical vantage points to academic readership, health and social care professionals, policymakers, other stakeholders as well as the general audience on the effects of digitalisation in care for older people.

This book offers an analytical review of the state of knowledge on elderly sexual abuse and presents new data that will confront some of the accepted ideas and some of the myths associated with this specific form of sexual violence. Sexual violence research has often considered children to be the most vulnerable population. However, another population just as vulnerable to sexual abuse but often overlooked by researchers, is the elderly. Evidence shows that elderly victims are more likely to be attacked by strangers, most likely to be victimized in their own homes, and are usually less capable of resisting a physical attack.

Drawing on a large and representative dataset, Elderly Sexual Abuse offers a full and theoretically informed picture of the offenders and their crimes. In addition to a specific chapter devoted to prevention and criminal investigation, the book also connects research to practice, exploring what the findings mean for professionals working with these cases and the criminal justice system.

This book is essential reading for all those engaged with sexual violence, victimization, elder abuse, and vulnerable populations.

This book explores the societal resistance to accessibility for persons with disabilities, and tries to set an example of how to study exclusion in a time when numerous policies promise inclusion.

With 12 chapters organised in three parts, the book takes a comprehensive approach to accessibility, covering transport and communication, knowledge and education, law and organisation. Topics within a wide cross-disciplinary field are covered, including disability studies, social work, sociology, ethnology, social anthropology, and history. The main example is Sweden, with its implementation of the United Nations Convention on the Rights of Persons with Disabilities within the context of the Nordic welfare state. By identifying and discussing persistent social and cultural conditions as well as recurring situations and interactions that nurture resistance to advancing accessibility, despite various strong laws promoting it, the book's conclusions are widely transferable. It argues for the value of alternating between methods, theoretical perspectives, and datasets to explore how new arenas, resources and technologies cause new accessibility concerns - and possibilities - for persons living with impairments. We need to be able to follow actors closely to uncover how they feel, act, and argue, but also to connect to wider discursive and institutional patterns and systems.

This book will be of interest to scholars and students of disability studies, social work, sociology, ethnology, social anthropology, political science, and organisation studies.

Once understood as useful but optional, case conceptualization is now considered essential and one of the most important of all clinical skills and competencies. As clinicians look for resources to assist in learning and mastering this competency, they must choose among different case conceptualization approaches considering those that are both clinically effective and clinician friendly. A truly clinically effective approach explains and guides treatment, and most importantly, predicts challenges and obstacles that are likely to arise over the course of treatment. Most approaches emphasize explaning and guiding treatment, but seldom include third function which helps anticipate likely challenges, which if not proactively addressed, are likely to result in therapy interference or premature termination. Research shows that such case conceptualization is essential in determining the course and overall effectiveness of therapy. This essential task can be completed in as little as fifteen minutes. A truly clinician-friendly approach is one that is quick to use and easy to master. The 15 Minutes Case Conceptualization is evidence-based, step-by-step approach that is both highly effective and clinician friendly.

This book showcases rights based participatory approaches to policy-making, practice and research with children and youth.

Throughout its three parts, the book conceptualises a rights-based participatory approach; showcases constructive and innovative rights based participatory approaches across the domains of research, policy and practice; and interrogates the challenges and complexities in the implementation of such an approach. In recent times, Ireland has been at the forefront of promoting and implementing participatory approaches to policy-making, practice and research focused on children and youth. This edited volume is a timely opportunity to capture previously undocumented learning generated from a wide range of innovative participatory initiatives implemented in Ireland. In capturing this learning, real world guidance will be provided to international policy-makers, practitioners and researchers working with children and youth.

This book is essential reading for those interested in a rights based participatory approach, for those who want to appropriately and meaningfully engage children and youth in research, and for those wishing to maximise the contribution of children and youth in policy-making.

The European Parliament (EP) - a powerful actor in today's European Union - was not intended to be more than a consultative assembly at first. Yet this book shows that the EP was much more influential in shaping Community policy in the early years of the integration process than either the founding Treaties or most existing scholarship would allow. It studies the EP's institutional evolution through the lens of Community social policy, a policy area with a particularly strong ideational dimension. By promoting a European social dimension, Members of the EP (MEPs) presented the Parliament as the true representative of European citizens by channelling their interests and needs. MEPs thus emphasised the EP's role as a provider of democratic legitimacy for Community politics, whilst at the same time trying to convince European citizens that the Communities could have a real and positive impact on their everyday lives.

Understanding Disability Throughout History explores seldom-heard voices from the past by studying the hidden lives of disabled people before the concept of disability existed culturally, socially and administratively.

The book focuses on Iceland from the Age of Settlement, traditionally considered to have taken place from 874 to 930, until the 1936 Law on Social Security (Loeg um almannatryggingar), which is the first time that disabled people were referenced in Iceland as a legal or administrative category. Data sources analysed in the project represent a broad range of materials that are not often featured in the study of disability, such as bone collections, medieval literature and census data from the early modern era, archaeological remains, historical archives, folktales and legends, personal narratives and museum displays. The ten chapters include contributions from multidisciplinary team of experts working in the fields of Disability Studies, History, Archaeology, Medieval Icelandic Literature, Folklore and Ethnology, Anthropology, Museum Studies, and Archival Sciences, along with a collection of post-doctoral and graduate students.

The volume will be of interest to all scholars and students of disability studies, history, medieval studies, ethnology, folklore, and archaeology.

This book explores how intersectionality theory can be applied to social work practice with children and families, older people and mental health service users, and used to engage with diversity and difference in social work education and research.

With case-study examples and practice questions throughout, the book provides a model for integrating intersectionality theory into social work practice. It highlights the ways intersectional theory helps us to understand the complexities of working with the interlocking nature of problematised elements such as gender, race, class, sexuality, disability, and other axes of structural inequalities experienced by groups in subjugated social locations. Intersectionality is used to examine multiple forms of inequalities and the complexities and questions they give rise to in social work practice. The emphasis throughout is that intersectional approaches can open up social work practice to new understandings of the complex linkages of multiple and intersecting systems of oppression that shape the lived experiences of diverse groups of service users.

Providing an introduction to an intersectional theoretical framework for understanding the lives and experiences of socially disadvantaged service users, Intersectionality for Social Workers will be required reading on all modules on anti-oppressive and anti-discriminatory practice, sociology, and ethics and values in social work.

The promotion of social protection in Sub-Saharan Africa happens in a context where informal labour markets constitute the norm, and where most workers live uncertain livelihoods with very limited access to official social protection. The dominant social protection agenda and the associated literature come with an almost exclusive focus on donor and state programmes even if their coverage is limited to small parts of the populations - and in no way stands measure to the needs. In these circumstances, people depend on other means of protection and cushioning against risks and vulnerabilities including different forms of collective self-organizing providing alternative forms of social protection. These informal, bottom-up forms of social protection are at a nascent stage of social protection discussions and little is known about the extent or models of these informal mechanisms.

This book seeks to fill this gap by focusing on three important sectors of informal work, namely: transport, construction, and micro-trade in Kenya and Tanzania. It explores how the global social protection agenda interacts with informal contexts and how it fits with the actual realities of the informal workers. Consequently, the authors examine and compare the social protection models conceptualized and implemented 'from above' by the public authorities in Tanzania and Kenya with social protection mechanisms 'from below' by the informal workers own collective associations.

The book will be of interest to academics in International Development Studies, Political Economy, and African Studies, as well as development practitioners and policy communities.

For the last 20 years, the Innocenti Report Card series has led the way in comparing children's well-being across rich countries. Report Card 16 develops this further through a multi-level approach to show that children's well-being is influenced by children's own actions and relationships, by the networks and resources of their caregivers, and by public policies and the national context. This approach is aligned with the 1989 United Nations Convention on the Rights of the Child, in that it recognises the responsibilities of governments, families and communities to help realize children's rights and promote their well-being

This book addresses the concept of parental alienation - the belief that when a child of divorced parents avoids one parent, it may be because the preferred parent has persuaded the child to do this. It argues against the unquestioning use of parental alienation concepts in child custody conflicts.

Increasing use of this concept in family courts has led at times to placement of children with abusive or violent parents, damage to the lives of preferred parents, and the use of treatments that have not been shown to be safe or effective. The 13 chapters cover the history and theory of "parental alienation" principles and practices. Methodological and research issues are considered, and diagnostic and treatment methods associated with "parental alienation" beliefs as well as those recommended by research and ethical evidence are analyzed. The connections of "parental alienation" with gender and domestic violence issues are discussed as are the experiences of individuals who have experienced "parental alienation" treatments. The book argues that "parental alienation" principles and practices should be avoided by family courts, in the best interests of children in custody disputes.

This book will be useful reading for lawyers, judges, children's services workers including social workers, child protection court workers, and mental health professionals involved in child custody decisions.

Since 2010 the UK has enacted radical welfare reforms that have led to greater poverty, homelessness, indebtedness, and foodbank use. It has diverged from other European countries experiencing similar economic and social trends, who have not enacted such dramatic cuts and reforms. Until recently, however, the changes proved very popular with the public, who increasingly hated the welfare system and viewed its users as lazy, undeserving, and likely to be cheating. In this book, Tom O'Grady focuses on policies that provide relief from unemployment, poverty, and disability to uncover why Britain's welfare system has been reformed so radically and why, until recently, the public enthusiastically endorsed this programme. Using a comparative and historical perspective, he traces the evolution of British welfare policy, politics, discourse, and public opinion since the 1980s, and argues that from the 1990s a long-term change in discourse from both politicians and the media caused the British public to turn against welfare by 2010. That, combined with the financial crisis, left the system uniquely vulnerable to cuts. This book explores the roots of public opinion on the welfare system, the motives of politicians who have revolutionized it, and the ways in which the system and its users have been spoken about. It is an account of how the public came to consider deserving recipients of help as scroungers; of when and why politicians and the media vilified them; of political parties whose discourse and policies were transformed, almost overnight; and of Britain's journey from providing welfare as generously as the average European country in the 1970s to becoming an outlier today.

This Open Access book presents unique evidence from the first comprehensive study of the outcomes of open adoption from care in Australia. It contributes to the international debate concerning the advantages and disadvantages of face-to-face post adoption contact with birth families.

The chapters assess whether adoption provides a better chance of permanence and more positive outcomes than long-term foster care for abused and neglected children in care who cannot safely return to their birth families. They also explore whether open adoption can avoid some of the detrimental consequences of past policies in which adoption was shrouded in secrecy and children frequently grew up with a conflicted sense of identity. The book will appeal to policy makers, practitioners and students of social policy, social work, the law, psychology and psychiatry. It should also be of interest to adult adoptees and adoptive parents, whose experiences it reflects.

This new edited collection brings together historians and social scientists to engage with the global history of Universal Basic Income (UBI) and offer historically-rich perspectives on contemporary debates about the future of work. In particular, the book goes beyond a genealogy of a seemingly utopian idea to explore how the meaning and reception of basic income proposals has changed over time. The study of UBI provides a prism through which we can understand how different intellectual traditions, political agents, and policy problems have opened up space for new thinking about work and welfare at critical moments.

Contributions range broadly across time and space, from Milton Friedman and the debate over guaranteed income in the post-war United States to the emergence of the European basic income movement in the 1980s and the politics of cash transfers in contemporary South Africa. Taken together, these chapters address comparative questions: why do proposals for a guaranteed minimum income emerge at some times and recede into the background in others? What kinds of problems is basic income designed to solve, and how have policy proposals been shaped by changing attitudes to gender roles and the boundaries of social citizenship? What role have transnational networks played in carrying UBI proposals between the global north and the global south, and how does the politics of basic income vary between these contexts?

In short, the book builds on a growing body of scholarship on UBI and lays the groundwork for a much richer understanding of the history of this radical proposal.

Insurance Economics brings together the economic analysis of decision making under risk, risk management and demand for insurance among individuals and corporations, objectives pursued and management tools used by insurance companies, the regulation of insurance, and the division of labor between private and social insurance.

Appropriate both for advanced undergraduate and graduate students of economics, management, and finance, this text provides the background required to understand current research. Predictions derived from theoretical arguments are not merely stated, but also related to empirical evidence. Throughout the book, conclusions summarize key results, helping readers to check their knowledge and comprehension. Issues discussed include paradoxes in decision making under risk and attempts at their resolution, moral hazard and adverse selection including the possibility of a "death spiral", and future challenges to both private and social insurance such as globalization and the availability of genetic information.

This second edition has been extensively revised. Most importantly, substantial content has been added to represent the evolution of risk-related research. A new chapter, Insurance Demand II: Nontraditional Approaches, provides a timely addition in view of recent developments in risk theory and insurance. Previous discussions of Enterprise Risk Management, long-term care insurance, adverse selection, and moral hazard have all been updated. In an effort to expand the global reach of the text, evidence and research from the U.S. and China have also been added.

This book revisits a distinction introduced in 1921 by economists Frank Knight and John Maynard Keynes: that between statistically predictable future events ('risks') and statistically unpredictable, uncertain events ('uncertainties'). Governments have generally ignored the latter, perceiving phenomena such as pandemics, natural disasters and climate change as uncontrollable Acts of God. As a result, there has been little if any preparation for future catastrophes. Our modern society is more interconnected and more globalized than ever. Dealing with uncertain future events requires a stronger and more globally coordinated government response. This book suggests a larger, more global government role in dealing with these disasters and keeping economic inequalities low. Major institutional changes, such as regulating the private sector for the common good and dealing with special harms, risks and crises, especially those concerning climate change and pandemics, are necessary in order to achieve any semblance of future progress for humankind.

What are skill-mix innovations and why are they relevant? This systemic analysis of health workforce skill-mix innovations provides an overview of the evidence and lessons for implementation across multiple countries. The authors focus on six core segments of health systems: health promotion and prevention, acute care, chronic care, long-term and palliative care, as well as access for vulnerable groups and people living in underserved areas. In addition, the book analyses the roles of educational systems, workforce planning and policy, and financing within individual countries' healthcare organisations from a cross-country perspective. Although implementing skill-mix changes may be prone to stakeholder opposition or other barriers, this book helps identify ways to steer the process. The authors ultimately determine what skill-mix innovations exist, who may benefit from the changes and how to implement these changes within health systems. This Open Access title is the sixth book in Cambridge's European Observatory on Health Systems and Policies series.

The lasting turmoil associated with the unprecedented pandemic, triggered by the novel corona virus COVID-19, has dragged the world into a mud of uncertainty. Fiscal stimulation, interest rate cuts, global supply-chain redeployment, "pandemic bond" and circuit breakers kicked in and the world is responding to this great challenge. But how can finance and economic research help the world under such circumstances?

This book dwells on this new area of research and tries to understand how pandemics impact the economic and financial ecosystem of both emerging and advanced economies. Lessons learnt from the experience of previous pandemics maybe presented and discussed through drawing on policy lessons to date. By gathering research on political economy, geopolitical issues, behavioral finance, international institutional responses and medical and health issues resulting from pandemics, the chapters in this edited volume help in expanding the knowledge of social and economic consequences of the pandemic as well as set the foundation for future research. This book would benefit scholars, policy makers and entrepreneurs worldwide as a valuable archive of research on pandemics.

The chapters in this book were originally published as a special issue of Emerging Markets Finance and Trade.

Embracing Age: How Catholic Nuns Became Models of Aging Well examines a community of individuals whose aging trajectories contrast mainstream American experiences. In mainstream American society, aging is presented as a "problem," a state to be avoided as long as possible, a state that threatens one's ability to maintain independence, autonomy, control over one's surroundings. Aging "well" (or avoiding aging) has become a twenty-first century American preoccupation. Embracing Age provides a window into the everyday lives of American Catholic nuns who experience longevity and remarkable health and well-being at the end of life. Catholic nuns aren't only healthier in older age, they are healthier because they practice a culture of acceptance and grace around aging. Embracing Age demonstrates how aging in the convent becomes understood by the nuns to be a natural part of the life course, not one to be feared or avoided. Anna I. Corwin shows readers how Catholic nuns create a cultural community that provides a model for how to grow old, decline, and die that is both embedded in American culture and quite distinct from other American models.
