Secession is a live issue in today's Western Europe. In the last decade, we have witnessed the consolidation of pro-independence movements in Scotland and Catalonia and in the near future, we might see their re-emergence or the rise of other pro-secession movements in other European regions. The response of the EU institutions to secession within EU Member States may well be based mainly on political considerations. However, since the EU is a community based on the rule of law, it has also to justify its position with normative arguments of principle. Secession and European Union Law provides such normative support, drawing on a pluralist reading of the relation between EU law and national law, to support the conclusion that EU law should respect domestic constitutional orders. This book studies secession within EU Member States through legal methodology: the theoretical-doctrinal analysis of concepts and institutions, considering the evolving reality and case law. The legal approach has three dimensions, given the three different legal orders that interact at the EU level: international law, EU law and national constitutional law. Based on Article 4 (2) TEU, the central claim of this book is that the EU duty to respect national identity and fundamental constitutional structures generate obligations to respect Member States' constitutional orders, provided that the values enshrined in the Article are not violated by the Member State affected. Recent developments, including anti-democratic moves by governments in Hungary, India, and Turkey and the rise of populist leaders, demonstrate the threat posed to democratic values by legal revolution and other acts committed within the confines of the system. Militant democracy, a form of constitutional entrenchment, can protect these values from the harmful influence of illiberal regimes. However, critics and proponents alike wonder whether these tactics risk undermining democracy in the process of trying to save it. Democracy despite Itself advances a liberal normative theory of militant democracy by combining American philosopher John Rawls' political liberalism with German jurist Carl Schmitt's state theory. It argues for the adoption of three constitutional mechanisms of militant democracy-explicit unamendability, political rights restrictions, and the guardianship of a constitutional court-to prevent the subversion and erosion of democracy by the abuse of legal measures. Rawls' thought provides the substantive democratic content of this theory, establishing basic liberal rights as a precondition for legitimate government. Schmitt's thought provides the militant political form, justifying the state's use of proactive militant measures to preserve the political identity of its constitution. This blending of works by two thinkers rarely regarded as complementary is a novel approach that offers a compelling vision for how liberal democracy can be protected from anti-democratic actors.

This book assesses the EU legal framework applicable to dairy products obtained through precision fermentation. It maps the authorisation and labelling requirements for these products to be placed on the EU market. It compares these provisions to those governing the food markets in the USA and Singapore, which are considered to be more innovation-friendly. At the time of writing, the precision-fermented dairy sector is still in the developmental phase, with only a few precision-fermented dairy alternatives available on the market, none of which are present in the EU. Regulatory uncertainty has been cited as significant obstacle for food business operators seeking to introduce alternative protein products in the EU. The book confirms these reports, as the current EU regulatory framework presents several legal uncertainties that are challenging for food business operators to overcome. Broadly speaking, there are two authorisation frameworks applicable to dairy products obtained through precision fermentation in the EU. The choice between these frameworks depends on the presence of genetically modified organisms (GMOs) or residues thereof in the final product. If such GMOs or residues are present, the pre-market authorisation procedure is governed by the Genetically Modified Food and Feed Regulation (GMFR). If the final product does not contain any GMOs or residues, it falls under the scope of the Novel Food Regulation (NFR), and the pre-market authorisation procedure is governed accordingly. Both of these authorisation pathways entail high regulatory requirements, which can pose challenges for the development of the precision fermentation sector. Despite the difficulty in accurately classifying products, it is crucial for food business operators to comprehend the applicable legal framework early in the product development process, given that the authorisation paths differ in their standards. In addition to pre-market authorisation requirements, companies must address labelling issues. Food labelling shall provide a basis for consumers to make informed choices in relation to the foods they consume. The primary objective of EU food labelling law is to prevent consumer deception , making it crucial for dairy products and their animal-free alternatives, to adhere to a stringent naming law as stipulated in the Common Market Organisation and specific accompanying legislation. Moreover, it is imperative to consider regulations regarding the use of health and nutrition claims, as well as labels such as "vegan" or "organic", etc. Furthermore, the labelling of novel foods and genetically modified foods may necessitate mandatory information specified in the authorisation process. The book serves as a comprehensive guideline for food business operators involved in the production of precision-fermented dairy alternatives, aiding them in navigating the intricate European regulatory landscape.

Hobbes's Elements of Law was written in 1640, on the eve of the English Civil War. It circulated in manuscript, and eleven manuscripts now survive. Two of them contain a substantial amount of material in Hobbes's own handwriting. Soon after writing it, Hobbes fled to France, while in England civil war broke out over many of the issues discussed by Hobbes in this book. In France he wrote a Latin version of his political theory (De Cive, on the Citizen), and then the English Leviathan, of which a Latin revision followed and in which he greatly expanded what he had to say about religion and church-state relations. The Elements of Law presents a complete but succinct version of Hobbes's political theory and of his more general philosophy. It analyzes the nature of knowledge and science, discusses psychology and human nature, surveys the rights and duties of individuals, and argues for the need of states to be governed by sovereign authority. It discusses the relationship between politics and religion, and the extent and limitations of political power. It is 'a work of extraordinary assurance, an almost fully fledged statement of Hobbes's entire political philosophy'. (Noel Malcolm) This edition is intended to replace the one edited by Ferdinand Toennies (1889), from which that of J.C.A. Gaskin (Oxford World's Classics, 1994) derives. It establishes a more accurate text based on all the eleven known manuscripts, and includes much material omitted by Toennies (who knew of only six manuscripts). It draws extensively on modern scholarship on Hobbes and his contexts.
