While tenders for IT managed services have evolved, key areas that drive significant business value for customers have seen limited improvement. When collaboration between IT service providers and customers stagnates, the next innovation cycle may not begin for another three years. In today's fast-paced business environment, few industries can afford such delays. Adaptive IT tenders aim to shorten this cycle, with a stronger focus on innovation and collaboration. These approaches are not just suited to agile companies, but also to more traditional organisations.

This book provides all stakeholders involved in the tendering and management of IT services with a practical set of methods for adaptive tendering. Whether you are part of the executive board, management, a specialist department, IT, sales, purchasing, legal, consulting, or operations, the book offers in-depth guidance on adaptive strategies, comparing them to traditional approaches. Additionally, a glossary is included to ensure clarity and help close any knowledge gaps.

This book discusses the impact of international migrants and refugees in the Middle East in the context of the Covid-19 pandemic, focusing on 3 main questions: What has the role of international migrants been in coping with Covid-19? How has this international health crisis affected international migrants and refugees? How has it affected socio-economic and political structures? The authors assess the relationship between healthcare, international migration and the pandemic through specific case-studies including: Tuerkiye, with reference to the case of Uzbek and Georgian migrant women, Tuerkiye with reference to Turkish citizens' attitudes towards Syrian refugees, Palestinian camps in Lebanon, Saudi Arabia and students' and immigrant professors' ethnographic experiences, the Arab Gulf countries and the Pakistan Medical Centre in Dubai, Arabia and the case-study of Oman, and Iran. The argument seeks to move beyond the idea of migrants as victims of the pandemic, and sheds light on the active role and agency of migrants to underline their substantive contribution to coping with the health crisis.

This book explores the 'gender pain gap'-the systemic disparities in how women's chronic pain and illness are perceived, believed, and treated. Focusing especially on conditions without visible markers, Eilidh Galbraith examines why women's pain remains socially, culturally, and theologically problematic. Through interdisciplinary analysis and qualitative storytelling, she investigates how power dynamics shape medical responses and influence women's credibility as narrators of their own suffering. Drawing on feminist theology, trauma studies, and health research, Galbraith weaves together her own experiences with those of other women to reveal how silence and disbelief impact health outcomes and identity. This deeply personal study challenges dominant narratives and calls for a more compassionate, justice-oriented approach to women's pain.

Justice at the Boundaries offers a powerful ethnographic account of the transformative potential and structural limitations of Taiwan's system of ad hoc Chambers of Indigenous Courts. Drawing on immersive fieldwork in courtrooms and Indigenous communities, J. Christopher Upton examines how judges, Indigenous litigants, and cultural brokers navigate contested terrains of law, identity, and sovereignty in a legal system shaped by ongoing processes of colonialism and aspirations of multiculturalism. From invocations of Indigenous laws to appeals to international human rights norms, the book reveals how courtroom encounters become sites of cultural negotiation, resistance, and possibility. Upton shows how Taiwan's Indigenous courts and other "boundary institutions" designed to bridge Indigenous and non-Indigenous worlds both challenge and reproduce entrenched hierarchies and power dynamics. The book brings fresh methodological and conceptual tools to the study of legal pluralism, Indigenous courts, Indigenous peoples' rights, and the complex politics of Indigenous recognition in the Asia-Pacific region and beyond.

Anxiety accompanies us whenever and wherever we are. It is part of being human. Humans are creatures of anxiety, and this shapes their relationship to the world, to others, and to themselves. In order to highlight the different ways in which anxiety manifests, a distinction is proposed between three basic functions: affective fear, felt anxieties, and mental anxiety. Each represents a specific form of vital danger management, encompassing not only physical protection functions but also the mental anticipation of possible risks and threats. However, anxiety-particularly in the form of emotional experiences-can become imbalanced, be experienced as distressing, and even become pathological.

Therefore, it is hoped that people possess the mental strength to meaningfully incorporate their anxieties into their lives. To offer a nuanced perspective of the topic, relevant theories from biology, psychology, sociology, and philosophy are considered, with further exploration of the findings in social, political, and ideological-worldview applications.

This book explores whether the World Bank Group, despite not being formally bound by international human rights law, operates in accordance with it when financing investment projects involving indigenous peoples, who are often among the most impacted.

The inquiry proceeds along two principal strands, grounded in the distinction between operations targeting public and private sector recipients. First, it traces the evolution of the World Bank Group's policies on indigenous peoples, which are binding on its staff and, once incorporated into loan agreements, on financing recipients as well. Second, it examines the interpretative practice of the organization's Independent Accountability Mechanisms, which review compliance with these policies throughout the project cycle. It finds that the policies have evolved alongside key developments in international law and that the Independent Accountability Mechanisms consistently reference both hard and soft international legal instruments in their assessments.

Building on these findings, the book reconsiders whether the World Bank Group may, in fact, be subject to international human rights obligations. Departing from traditional deductive reasoning, it adopts an inductive approach grounded in institutional practice. It argues that the World Bank Group, as an international legal actor, is bound by an emerging body of rules and principles of general international law and calls for a reassessment of the organization's role in shaping the human rights discourse on indigenous peoples.

This book offers a range of critical narratives on the interplay between constitutional polycrisis and emergency constitutionalism. They are integrated by the desire to both expose cracks in the current schemes for taming conflict, crisis, and non-normalcy and to demonstrate the constitutional shapes of the emerging post-crisis and post-transition world order. The book shows that a constitutional crisis is a multidimensional phenomenon. It outlines the legal (normative-institutional), socio-legal (empirical, performative, and socio-institutional), theoretical (conceptual and phenomenological), and imaginary dimensions of crisis. The book critically exposes the fallacy of emergency constitutionalism, consisting in the claim that emergency is a temporal and efficient crisis response. It shows that emergency constitutionalism may be the formative tool of a new crisis-borne and emergency-related normalcy. The mission of this book is to raise awareness of the tendencies towards paternalism, emergency governance, and government of fear.

This edited book provides a comprehensive study of punitive practices in modern-day Lithuania, highlighting its significance as a democratic European state navigating the continuing consequences of its Soviet-era criminal justice system. Punitive attitudes and practices are explored through a thematic framework, examining their socio-political, cultural, and historical contexts. Part I traces the cultural, psychological, and historical origins of punishment, highlighting the influence of collective memory and transitional reforms on penal debates. Part II examines the uneven application of criminal justice, showing how it unfairly punishes marginalised and disadvantaged communities. Part III explores advancements in probation, imprisonment, crime prevention, and victim support, showing how reforms can become both symbolic and oppressive. The book offers various criminological viewpoints that contribute to policy discussions about reducing excessive punishment, exploring alternatives, and promoting meaningful justice reform. This vital resource supports the work of scholars in criminology, sociology, law, and related fields focused on social justice and democratic reform.

This book explores key innovations in the EU-Vietnam Investment Protection Agreement that shape Vietnam's ability to regulate for environmental protection-an essential pillar of sustainable development. It places this regulatory power within Vietnam's broader historical and developmental context, offering analysis relevant to emerging economies.

Rather than assessing all levels of investment protection, the book focuses on specific provisions that support a host state's ability to adopt environmental and sustainable development measures. It examines how these clauses function in practice and the challenges they present, especially for developing countries.

Existing literature often addresses investment protection in abstract or general terms. This book takes a more grounded approach, exploring how broad principles interact with Vietnam's legal capacity, policy needs, and developmental constraints. It argues that divergence from generalised assumptions is not a contradiction, but a reflection of differentiated conditions, including environmental urgency, institutional capacity, and the risk of "regulatory chill," where states may hesitate to act for fear of investor claims.

The book offers practical insights for negotiators, policymakers, and legal practitioners involved in foreign investment governance, especially in emerging economies. It also serves as a valuable reference for scholars and stakeholders - particularly in the EU - seeking to understand the regulatory priorities and limitations of their partners.

Court decisions can neither be made nor drafted without references to other texts; citations are omnipresent in judicial rulings. Every decision takes relevant normative texts or precedents into account, primarily to ensure coherent case law. Through the act of referencing, courts demonstrate that their decisions are based on an established legal doctrine. This integration into the existing doctrine legitimizes the decision and thus creates legal certainty through predictability.

Moreover, court decisions also contain references to texts that do not possess legal authority and therefore cannot be assigned such a function. Among the sources cited by courts, alongside statutory texts, are-for example-references to foreign law, scholarly sources, or even literary texts.

In view of this, the present study addresses the question of how and why courts cite. Using decisions from the Federal Constitutional Court of Germany and the Supreme Court of Canada as examples, the interdisciplinary study proposes both philological and legal evaluation criteria for the empirical reconstruction of citation functions and furthermore adopts a comparative perspective on jurisdiction-related differences in citation practices in courts.

The legal profession is at a pivotal moment.

Rapid technological advances, rising competition from unexpected directions, shifting client demands, and changing expectations from top talent are reshaping the legal profession right before our eyes. To stay ahead and thrive, law firm leaders must build future-ready firms-organizations that proactively lead transformation and respond to disruption with agility.

This book is a practical, research-backed guide to unlocking peak performance and driving transformation across the entire firm by focusing on the most overlooked success factor: the people who shape and drive the firm's future. Leaders who successfully empower people to adapt to and actively drive transformation will shape the future of the legal profession.

Drawing on over 20 years of experience advising top law firm leaders, 35 in-depth interviews with managing partners, COOs, CHROs, and other senior leaders, and three decades of research in behavioral, human, and business sciences, Prof. Dr. Madeleine Bernhardt, LL.M., introduces a structured, science-based framework covering nine critical areas leaders must address to achieve successful transformation.

Together, these areas enable the development of a strong and adaptive law firm culture-the key to leading transformation effectively and future-proofing the firm.

This book helps leaders in the legal profession to:

  • lead transformation at three levels-firm, team, and individual
  • unlock human potential for performance, empowering individuals and teams to unlearn old habits, embrace new ways of working, and drive transformation
  • build a strong and adaptive culture across the firm-essential to any strategic transformation
  • future-proof their firms, enabling them to thrive in a time of high complexity and dynamic change.

Whether managing partner, COO, CHRO, or senior leader, readers will find in this book the proven concepts and methods needed to lead with impact in times of volatility, uncertainty, complexity, and ambiguity (VUCA)-and to build future-ready firms that actively shape and adapt to a fast-paced environment.

Today more than ever, a firm's success depends on its leaders' ability to skillfully lead people, teams, and the entire organization through transformation-to win the future.

First providing a new and thought-provoking interpretation of the Spinoza Controversy of around 1800, and the Controversy's reprise in the 1920s, this work then makes a compelling case for the Controversy's ongoing vital relevance. If the Spinoza Controversy has historically been one of the few times our mainstream discourse has adequately identified and opposed the fatal early German romantic flaw which still lies at the heart of Western scientific naturalism - the unfounded belief that necessity relations are really, and not ideally, ontological - then the Controversy's lens is invaluable now, in an era characterized by our still deeply underestimated and mischaracterized environmental nihilism, a multifaceted condition in line with which we cognitively and philosophically nullify the actual external world while also increasingly physically rendering it nothing by removing, dismantling, and consuming it. In linking this nihilism with a romantic understanding of necessity over two centuries old, Snow shows how not only our environmental nihilism, but also our increasing belief in worlds even less real than Spinozistic naturalism's - such as the worlds ostensibly brought into being only through economic or, now, sheerly informatic, types of necessity - calls out for opening up, for a third and final time, the questions the Controversy affords us unique ways of asking regarding the purpose, the limits, and perhaps even the future, of Western theoretical rationality itself.

The book addresses the intersection of artificial intelligence, sustainability, and solidarity in the context of promoting European values, offering critical insights from various branches of law, including European Union Law, International Law, Public Law, and Private Law. This compilation is a result of the 14th edition of the prestigious International Conference "Perspectives of Business Law in the Third Millennium" (businesslawconference.ro), held in November 2024 in Bucharest, and brings together contributions from leading scholars, practitioners, and policymakers. The work analyses how emerging technologies, particularly artificial intelligence, influence economic, social, and legal processes, shaping new directions for sustainable development. It brings to the forefront both the harmonisation of technological progress with fundamental European principles and the importance of solidarity and social cohesion. The authors of this collective volume have not overlooked the role of public policies and regulations in ensuring fair transitions towards a sustainable digital economy, where human rights and social inclusion are paramount. Additionally, the book highlights scientific novelties such as the public domain of cyber-space-time, the challenges and opportunities of balanced integration of new technologies, and underscores the importance of collaboration between states, institutions, and the private sector to build a future founded on responsible innovation. This work is aimed at academics, researchers, policymakers, entrepreneurs, and even students, as well as all those interested in the impact of technology on society and the economy. It is also a valuable resource for specialists in public policy, international law, European studies, and sustainability.

The primary challenges lie in managing the influence of dominant large platforms while striving to create a fairer, more accessible, and competitive European digital market. In response, the European Union has initiated a regulatory revolution with major legislative acts such as the Artificial Intelligence Act (Ai Act), Digital Markets Act (DMA) and the Digital Services Act (DSA). The book deals with the impact of these regulatory systems in selected Eu Member States.

Given the significance and cross-disciplinary nature of the topic, the book is divided in two main sections. The first section addresses the recently approved Artificial Intelligence Act and its impact on the regulatory framework and administrative systems of the specified Member States. In light of the increasing integration of artificial intelligence within the public sector across Europe, this section examines the existence of national legislation in the relevant countries and its relationship with the AI Act. Furthermore, this section investigates the organizational and institutional changes in the selected countries, as well as the reinterpretation of traditional principles of administrative law or the creation of new ones to align with the provisions of the Regulation. The second section delves into the complex landscape of the newly introduced DMA and DSA, focusing on the various institutional arrangements adopted by Member States and their national competent administrations to support this new EU legal regime. It provides a comprehensive and detailed understanding of the national-level implementation of these regulations and their implications, highlighting the institutional interplay and the complexities of effective regulation in the digital age.

This book provides insight into the luxury yacht (or superyacht) tourism market and industry. Superyacht tourism is a distinct form of tourism by virtue of the fact that luxury yacht consumers (guests) receive a bespoke vacation experience co-created with both the yachts' crew and associated allied agencies. Elaborating on these co-created superyacht experiences, the book explores the inputs of both guests and stakeholders and is unique in three main ways. Firstly, it presents insight into the luxury value proposition all the way from yacht design through to ownership, staffing, charter management and consumption. Secondly, it presents an understanding of the luxury yacht market proposition through the unifying framework of customer experience. In doing so the book follows the shift in focus from the material and symbolic elements of luxury towards the experiential element. Finally, the book incorporates both academic and industry expert insights into the co-creation of luxury yacht experiences.

The historic centre of the southern European city of Naples has been shaped by opposing urban processes throughout the 2010s and into the 2020s. On the one hand, touristification has led to the financialisation of housing, the displacement of inhabitants and everyday commerce, and the enclosure of public space. On the other, the proliferation of commoning practices by the Liberated Spaces or Beni Comuni-and the parallel experimentation with a distinctive form of new municipalism-has reclaimed urban space for collective use and social functions. The Liberated Spaces are a network of communities that have emerged since 2012 through the occupation and reappropriation of abandoned public buildings. Today, they are self-governed by inhabitants through assemblies.

Through in-depth ethnographic research with these communities, this book explores the everyday production of liberated spaces in the heart of the tourist zone. Moving from the bodies of activists to the body of the city and back, and with an eye to its past histories as recalled through the memories of its inhabitants, it traces the emergence of urban bodies contested between diverging trajectories and possible futures for Naples.

Starting from the hypothesis that all human forms of life have a political dimension - be it clearly expressed or hidden, conscious or unconscious - this volume examines the ways in which political life can be fruitfully analyzed with the help of phenomenological methodologies. Examining issues of power dynamics as they relate to pervasive epistemic and axiological commitments as well as deeply seated socio-cultural and institutional practices, this text opens and develops, through a radical critical lens and a commitment to the emancipatory potential of theoretical work, innovative paths for phenomenological investigations of the complex political aspects of our shared lived experiences. These investigations, both focused on the content matter at hand and on their own methodology, draw on phenomenological resources as well as resources from other philosophical traditions and fields, such as critical theory, feminist philosophy, and queer theory.

While various theories in political philosophy nurture an open suspicion about subject-oriented philosophical approaches (c.f., Adorno, Althusser, for example), this volume questions the status of the subject of political experience in order to explore multiple forms of political subjectivation. These guiding questions allow an investigation into a new field of research where phenomenological methodologies can help negotiate the political challenges of our time. This book appeals to students and researchers working in phenomenology and related disciplines.

During the eighteenth century, Spanish statesmen pursued a set of ambitious imperial reforms that thoroughly remade conceptualizations of empire. They compared well-ordered empires to harmonious machines and devised a comprehensive plan to liberalize and integrate the imperial economy. The main initiative to emerge from this economic plan was a commercial policy that contemporaries called comercio libre, which entailed replacing the traditional fleets and galleons with a new system of free trade within the empire. The men who designed this new imperial vision became convinced that the pursuit of markets, rather than military power alone, was the key to succeeding in a modern commercial society. Unlike their European counterparts, who remained keenly interested in international trade, Spanish ministers focused on integrating Spain's vast imperial economy. In their minds, the Hispanic world could become an integrated and self-sufficient microcosm of the global economy, which would enable the empire to partake in the world's trade without the rivalry and warfare that came from international commerce. Moving seamlessly between developments in Spain and Spanish America, Fidel J. Tavarez demonstrates how the imperial machine was projected to reap the benefits of economic growth by synergizing millions of people across Spain's dominions, including Indigenous and Afro-descendant colonial subjects. He traces the evolution of the empire's economy from extractive measures intended to drain colonial possessions of their resources for the metropole's gain to notions of a mutually beneficial and equal conglomeration of transoceanic territories. By bringing this effort to light, Tavarez shows that, rather than a mercantilist throwback, the Hispanic world's commercial reforms represented a genuine attempt to solve the dilemmas of early modern globalization, an endeavor that, in turn, inaugurated the enduring fascination with erecting trade blocs in Latin America. Combining economic, intellectual, and political history, Assembling an Imperial Machine provides an innovative interpretation of this momentous period in the history of the Hispanic world.

This edited volume examines the legal and economic world of the Romans through concepts, structures, and objects that reveal practices of standardization and localism. It explores the myriad ways in which the Roman Empire became an integrated political, social and economic system.

Split across two volumes, the collection addresses the dynamic interaction between Rome and its provinces in developing institutions crucial to societal and economic development. It challenges notions of uniformity, demonstrating how tensions between imperial standardization and local cultures could both drive innovative legal and economic practices and hinder empire-wide integration. The chapters explore broad questions from various disciplinary perspectives, including ancient economic history, law, papyrology, epigraphy and archaeology. Contributions cover diverse topics such as weights, measures, and coinage, legal practices, taxation, and cultural symbols. Each chapter investigates how, even as local communities adopted practices associated with Rome as a ruling power, local customs could, in turn, influence practices across the Empire.

By illuminating these reciprocal relationships, this book recontextualizes Roman standardization-not merely as a tool of imperial domination but as evidence of diverse socioeconomic practices and cross-cultural exchanges. It will be a valuable resource for scholars of ancient economic history, classical archaeology, and ancient law, as well as anyone interested in the economy and culture of Ancient Rome.

This book contributes new insights into the construction and implementation of global justice across different constituencies in the Global South. In particular, it investigates the impact of NGOs and victims' representatives on redress mechanisms for mass atrocities and violence, using the scholarly field of transitional justice. By utilising this scholarly lens, the book is able to draw into a wide range of discussions and mechanisms aimed at addressing mass violence and armed conflict in the Global South. These discussions are in line with the central question of how NGOs impact on the legitimacy of transitional justice processes. The book thus examines the question analytically and empirically, using the theory of legitimacy, as one of the ways in which to explain the power dynamics of global justice and institutions. It offers significant contributions to the existing literature on legitimacy in transitional justice, with country case specific examples of Uganda and Myanmar.

While the book is broadly framed within the scholarly field of transitional justice, it draws on two branches of international law -International Human Rights Law (IHRL) and International Criminal Law (ICL). It also benefits from scholarship in the field of international relations to explicate the legitimacy and institutional power of NGOs and international courts. These disciplines are converged through the literature review and analysis. The book will make a new contribution by adding empirical data on NGO work in transitional justice from two case studies. The thrust of the argument is that NGOs either enhance or reduce the legitimacy of transitional justice mechanisms. The concept of legitimacy will be used to analyse the way in which transitional justice is implemented.

A historical inquiry into Kantian philosophy as a form of philosophical religion

Kantian philosophy is typically viewed as providing a universal theory of knowledge and morality based on timeless principles retrieved from the human mind. In The Kantian Religion, Ian Hunter offers a starkly different account. Hunter contends that Kant's arguments were assembled from purely historical sources and served as ascetic devices for crafting the towering self of the Kantian philosopher; they were exercises in intellectual self-clarification and moral transformation undertaken by a cohort of the philosophically educated in search of spiritual clarity and moral purity. These "solemn rites of the mind" were seen as heir and rival to the regenerative resources and cultural importance of the Christian religion, and Kantianism was characterized as a philosophical religion.

Hunter describes the ways that elite spiritual athletes performed a series of philosophically strenuous "acts of the self on the self" through Kant's intellectual exercises. When Kantianism emerged as an insurgent cultural movement in the 1780s, it offered young academics training to be clergy and teachers a philosophy that was powerful enough to supplant Christian spirituality and to subordinate humanist scholarship and the natural sciences to philosophical self-reflection. For Kant and his followers, the religious disposition of Kantian philosophy came solely from the immanent practice of the philosophy itself. As a rival to conventional religion and as an academic interloper, Kantian philosophy unleashed a wave of conflicts in Germany's ecclesiastical and scholarly cultures. Although recent Kant commentary typically views Kantianism as intrinsically secular and scientific, Hunter argues provocatively that Kant's contemporaries viewed his philosophy as an extra-ecclesiastical path to spiritual refinement and moral regeneration.

This volume examines the state of the economic history discipline around the globe. It raises and answers questions such as: What are its roots, how did it evolve, and what is the current state of the discipline in each country or region presented?

Transcending traditional Western paradigms, the book gathers renowned economic historians from around the globe to engage in a comprehensive dialogue about economic history's global standing. Investigating its role in shaping future economists, addressing pivotal questions, and its symbiotic relationship with economics, contributors analyze economic history's resonance across continents. By doing so, the chapters are not intended to be a survey of the research on each country, but rather an overview of the discipline: its practice, training, and position within the broader economics discipline.

Addressing an academic audience, this book further analyzes the interplay of human capital scarcity and its profound impact on academia, spotlighting the evolution of economic history in diverse cultural and regional contexts. Scrutinizing historical milestones, such as Schumpeter's paradigm-shifting pillars and Romer's reflections, the book discusses the need to redefine economic history's role and takes readers on a journey through economic history from its pivotal role to its integration into the broader discipline.
