≫The Admissibility of Counter-Third-Party-Notice≪: To date, counter-third-party-notice (?Rueckverkuendung?) has been rejected by the courts as inadmissible. It refers to the third-party-notice whereby the party whom is notified counter-notifies the party who previously notified itself, in order to be able to invoke the legal effects of third-party-notice in its favor. This paper provides a fundamental examination of the requirements of Section 72 of the German Code of Civil Procedure (ZPO) and their analogous application to the case of counter-third-party-notice (?Rueckverkuendung?).
