Protection Against ?Inappropriate Settlement Pressure? from the Court in Civil Proceedings≪: The study is dedicated to the phenomenon of ≫inappropriate settlement pressure≪. The court settlement itself is already risky. The exercise of settlement pressure by the judge is unlawful as it affects section 278 (1) ZPO. The party is not sufficiently protected against this either de lege lata or lege ferenda. It is preferable to have a ban on the exercise of pressure in a new version of section 278 (1) sentence 2 ZPO that applies without exception in order to ensure preventive protection of the party.
