A constitutional Analysis Using the Example of Paragr. 47 (6) VwGO≪: The author takes the divergent interpretation of the standard of review in proceedings pursuant to Paragr. 47 (6) VwGO as an opportunity to analyse the constitutional limits of a heterogeneous handling of federal procedural law. The issues addressed include effective legal protection, procedural equality of arms, freedom from contradiction and equality in the application of the law. As a solution, an analogy is used to develop a preliminary procedure for procedural norms that cannot be the subject of a procedure suitable for standardisation.
