≫The Clergy‘s Privilege - Unconstitutional Special Religious Right? Paragr. 139 sec. 2 StGB and the Constitutional Protection of Life and Physical Integrity≪: The state has a duty to protect, amongst others, the legal interests of life and physical integrity. For these interests, the clergy's privilege under Paragr. 139 sec. 2 of the German Penal Code creates a lack of protection. This study examines, whether this can be justified by the special significance of religious freedom. To this end, the privilege’s constitutionality is assessed with regard to the fulfillment of the duty to protect, based on the restrictability of Art. 4 of the constitution.
