≫The Heirs of the “rei vindicatio” in the Modern Private Laws of Germany, England, and Scotland≪: This work explores those claims in the modern private laws of Germany, England, and Scotland which protect (vindicate) ownership against interferences and thus are reminiscent of the ancient Roman law-based action of rei vindicatio. After critically examining the individual concepts of ownership and possession, the individual claims available and their practical results the author concludes that the respective approaches to conflict resolution are similar in intention but vary greatly in detail.
