≫Liability for Litigation Errors in Model Cases Pursuant to the KapMuG and in Declaratory Model Actions Pursuant to Sections 606 et seq. ZPO≪: This paper examines the controversial question of whether the collective plaintiff and its attorneys bear responsibility in collective proceedings under the KapMuG and under Sections 606 - 613 ZPO for the outcome of the proceedings and whether they are liable to other participants in the proceedings for inadequate conduct of the proceedings. On the basis of the results found, possible variants for implementing the directive on representative actions into German law are then discussed.
