≫Absolute or Relative Priority of Creditor Classes in Restructuring Law≪: The absolute priority rule has been called ≫bankruptcy’s most important and famous rule≪. Yet, a European directive from 2019 ((EU) 2019/1023) has challenged this status and introduced a so called relative priority rule. Following a historical, comparative and economic legal analysis, the thesis evaluates both rules and the new exceptions to the absolute priority rule that were introduced into German restructuring law in 2021 (Paragr. 245 InsO and Paragr. 27 f. StaRUG).
