≫The Debt Brake of the Basic Law and its Implementation in the ?Laender?. A Contribution to Federal Public Debt Law after the Federalism Reform II≪: For the first time in German constitutional history, the German Debt Brake (Art. 109 para. 3 Basic Law) addresses concrete requirements for limiting new public debt on state level to the Laender. In order to make use of the legally permissible credit exceptions - the cyclical component and the emergency clause - the Laender must implement the Debt Brake in their state law. The thesis elaborates the constitutional requirements in the field of public debt law directed at the Laender, measures the legislative and executive design leeway and analyses some of the debt brakes implement by the ?Laender?.
