≫Is a plea bargain foreign to German criminal procedural law? A study under special consideration of the fair-trial-principle≪ The thesis considers weather plea bargaining fits into German criminal procedural law. Another issue discussed is the possibility of a coherent integration into German legal system with regard to its constitutional principles. The plea bargain should be integrated into German legislation mainly under consideration of the fair-trial-principle. This constitutes a completely new research approach. Subsequently, the author analyses the jurisprudence of the Federal Constitutional Court since 2013. She concludes that plea bargaining will always be foreign to German criminal proceedings. However, the legislator should attempt to adapt the plea bargain into German criminal procedural law to the extent possible.
