Extraterritorial Self-Defence in an Unwilling or Unable State According to recent State practice, a State imperilled by non-State actors is entitled to the use of force within the territory of another State, if the latter is unwilling or unable to constrain the threats these non-State actors pose. The study therefore examines whether the so-called ≫unwilling or unable standard≪ can be considered as part of the existing body of international law, as it puts the ban on the use of force ? a peremptory norm of general international law ? to a particular test.
