The Conflict between the Right of the State to Inflict Punishment and the Individual Right to Immunity in Special Consideration of a Development of International Customary Law Regarding an Exemption from Immunity for Non-Party States before the ICC≪ The conflict between the right of the state to inflict punishment and the individual right to immunity concerns the criminal persecution of crimes pertaining to international law committed by heads of state before the ICC. This paper shows that there is a development of international customary law regarding an exemption from personal immunity for governing heads of state (also of non-party states), which has been recognized before the ICC and which can also be extended to cross-national relations.
