≫Mutual Reinforcement of Fundamental Rights under the German Basic Law≪ In light of the intersecting nature of fundamental rights under the Basic Law, several rights may be invoked concurrently in certain cases. In her doctoral thesis, Julia Sandner explores whether this increases the level of protection by attaching greater weight to the affected rights positions in the balancing test under the principle of proportionality. Introducing a new approach for determining normative intersections, the author shows that this may create an effect of mutual reinforcement.
