The Protection of Human Rights in Germany and the United Kingdom provides a comprehensive comparison of the human rights regimes found in Germany, the UK and on the European level.
Breaking new ground in the comparative analysis of these legal systems the work covers the main substantive rights found in the German Basic Law of 1949, the European Convention for the Protection of Human Rights and Fundamental Freedoms of 1950, and the UK Human Rights Act of 1998. The book also addresses, inter alia, judicial approaches to analysis, access to courts and the effect of court procedures on human rights protection, as well as the influence of administrative law in the protection of the individual. Particular emphasis is put on the status of human rights under formal states of emergency and in times of societal crisis, such as the tensions created by the current global struggle against terrorism.
