A new regime for employment tribunals came into force on 1 October 2004. Designed to bring the employment tribunal procedure more in line with the Civil Procedure Rules 1998, some fear the new regulations will make the process more legalistic and complex. The main changes introduced include; complex admissibility provisions; longer period for responding to a claim, but with stricter rules about granting extensions and additional powers for the tribunal to make default judgments in such cases; a new power for tribunals to make wasted costs orders; a fixed conciliation period in most cases other than discrimination; and the greater use of case management by tribunals.
