An extensive examination of the law as it is applied to disabled persons. The law is analyzed by looking at a variety of statutes and how they affect the disabled. Although the focus is mainly on the impact of the Disability Discrimination Act, the book is not confined to just that Act and aims to encompass all the legislation relevant to disability in whatever sphere. It explains how the law is being applied and what implications the legislation has for the future. This is done not just in terms of employment rights under the Disability Discrimination Act, but also access to goods, facilities and services that able-bodied people take for granted. Additionally, housing, education, welfare, leisure and public transport are covered. As it is a new area of law, there is not a substantial body of decided case law. The approach taken therefore, is to explain the statutory provisions in terms of parliamentary intention, explanatory regulations and guidance and then to look at the application of the law to cases. Suggestions for further reading are offered at the end of each chapter. This method has been chosen to give the reader a thorough grounding in the statute before moving on to consider the case law because of the complex nature of the legislation and the guidance. The book includes the text of the Disability Discrimination Act, as amended, the Code of Practice, the Regulations and the Guidance on the Act.
