This book is unique in examining the full range of legal structures through which various forms of investment can be made. In relation to financial investment, the text analyses the core concepts of the trust and investment in shares in an ordinary company. These basic principles are then applied to pensions funds, eurobond issues and unit trusts, and to open-ended investment companies and investment trust companies. The analysis also incorporates legal analysis and new legislative proposals in relation to credit unions, industrial and provident societies, friendly societies and trade unions. The development of public sector investment is also considered in relation to Private Finance Initiatives, local government investment through social security payments and also NHS trusts. The aim of the book is to consider, across these many entities, the varying rights of investors, the obligations of fiduciary officers, and the structure of the entities themselves. This will also include a consideration of applicable regulatory regimes. Its core thesis is that radically different legal principles apply in different contexts, involving a trade-off between contract, property and fiduciary responsibility.
