The aim of this work is to bring home to law students the fact that the culture of the indigenous people of Australia is not something simply referred to in history books. It is in fact alive and pivotal to the existence and identity of indigenous Australians. With this realization comes the ability to understand the impact of the law in its various forms upon the indigenous people, the obstacles to their full participation in the community, and the rocky road to reconciliation. The book includes contributions from both indigenous and non-indigenous Australians on those areas of the law the impact of which is of importance to the indigenous Australians. Among the areas covered are the legacy of colonialism; de-racialization; empowerment, sentencing and the criminal justice system; native title; public health law; reconciliation and the constitution; copyright in the Dreaming; self-determination; common law and customary law; the ramifications of Mabo; and human rights.
