This book provides an important critique of mental health law and practice in China, with a focus on involuntary detention and treatment. The work explores China's mental health law reform regarding treatment decision-making in the new era of the UN Convention on the Rights of Persons with Disabilities (CRPD). It adopts a socio-legal approach, not only by undertaking a comprehensive desk-based analysis of the reforms introduced by China's Mental Health Law (MHL) but also examining its implementation based on evidence from practice. The book seeks to investigate whether China's first national MHL takes a step closer to the requirements of the UN Convention on the Rights of Persons with Disabilities on mental health treatment decision-making, and, if not, why not? The book will be of interest to those working in the areas of mental health law and policy, medical law and disability, human rights law, and Asian Studies.

The Future of Medical Device Regulation: Innovation and Protection. 350 pp. 2022:3 (Cambridge U. Pr., UK) <669-692>
ISBN 978-1-108-83863-4 hard ¥27,987.- (税込) GB£ 99.00 *

Regulators have been more permissive for medical devices compared to their drug and biologic counterparts. While innovative products can thereby reach consumers more quickly, this approach raises serious public health and safety concerns. Additionally, the nature of medical devices is rapidly changing, as software has become as important as hardware. Regulation must keep pace with the current developments and controversies of this technology. This volume provides a multidisciplinary evaluation of the ethical, legal, and regulatory concerns surrounding medical devices in the US and EU. For medical providers, policymakers, and other stakeholders, the book offers a framework for the opportunities and challenges on the horizon for medical device regulation. Readers will gain a nuanced overview of the latest developments in patient privacy and safety, innovation, and new regulatory laws. This book is also available as Open Access on Cambridge Core.

Sharing Linked Data for Health Research: Toward Better Decision Making. (Cambridge Bioethics and Law) 2022:6 (Cambridge U. Pr., UK) <669-443>
ISBN 978-1-108-42664-0 hard ¥24,877.- (税込) GB£ 88.00 *
Health research around the world relies on access to data, and much of the most valuable, reliable, and comprehensive data collections are held by governments. These collections, which contain data on whole populations, are a powerful tool in the hands of researchers, especially when they are linked and analyzed, and can help to address "wicked problems" in health and emerging global threats such as COVID-19. At the same time, these data collections contain sensitive information that must only be used in ways that respect the values, interests, and rights of individuals and their communities. Sharing Linked Data for Health Research provides a template for allowing research access to government data collections in a regulatory environment designed to build social license while supporting the research enterprise.

Bloody Bioethics: Why Prohibiting Plasma Compensation Harms Patients and Wrongs Donors. (Routledge Annals of Bioethics) 208 pp. 2022:3 (Routledge, UK) * paper 2024 <669-134>
ISBN 978-1-032-20386-7 hard ¥33,924.- (税込) GB£ 120.00
ISBN 978-1-032-20505-2 paper ¥11,304.- (税込) GB£ 39.99 *
This is the first book to argue in favor of paying people for their blood plasma. It does not merely argue that offering compensation to plasma donors is morally permissible. It argues that prohibiting donor compensation is morally wrong-and that it is morally wrong for all of the reasons that are offered against allowing donor compensation. Opponents of donor compensation claim that it will reduce the amount and quality of plasma obtained, exploit and coerce donors, and undermine social cohesion. James Stacey Taylor argues that empirical evidence demonstrates that compensating plasma donors greatly increases the amount of plasma obtained with no adverse effects on the quality of the pharmaceutical products that are manufactured from it. Prohibiting compensation thus harms patients by reducing their access to the medicines they need. He also argues that it is the prohibition of compensation-not its offer-that exploits donors, fails to respect the moral need to secure a person's authoritative consent to her treatment, and prevents donors from giving their informed consent to donate. Prohibiting compensation thus not only harms patients but also wrongs donors. Bloody Bioethics will appeal to researchers, advanced students, and medical professionals interested in bioethics, moral philosophy, and the moral limits of markets.

The Limits of Parental Authority: Childhood Wellbeing as a Social Good. (Routledge Annals of Bioethics) 202 pp. 2021:12 (Routledge, UK) * paper 2024 <669-120>
ISBN 978-0-367-45698-6 hard ¥40,991.- (税込) GB£ 145.00 *
ISBN 978-1-032-19400-4 paper ¥11,304.- (税込) GB£ 39.99 *
This book offers a novel theory of childhood well-being as a social good. It re-examines our fundamental assumptions about parenting, parental authority, and a liberal society's role in the raising of children. The author defends the idea that the good of a child is inexorably linked to the good of society. He identifies and critiques the problematic assumption that parenting is an extension of individual liberty and shows how we run into problems in medical decision-making for children because of this assumption. He develops an objective conception of what is good for a child in a liberal society, drawing on the assumptions of liberty, and from here constructs a set of things that society and its members owe children. There are ways in which society should support and intervene in parental decisions to guarantee a child's well-being. Ultimately, raising children is a social activity that requires input from society. The author then applies this theory of childhood well-being to develop a framework for medical decision-making for children. He also uses practical examples, such as vaccinations, parental leave, and healthcare access, to demonstrate the implications of his theory for public policy. The Limits of Parental Authority: Childhood Wellbeing as a Social Good will be of interest to practitioners, scholars, and advanced students working in bioethics, political philosophy, and public health policy.
